Terms and Conditions

Buffalo Towing Services — A Division of MCH Enterprises

1. Acceptance of These Terms

By using this website, requesting a quote, submitting a towing or roadside-assistance request, providing payment information, or accepting service from Buffalo Towing Services, you agree to these Terms and Conditions and all policies linked during checkout.

Do not submit a service request or payment authorization if you do not agree to these terms.

2. Business Information

Buffalo Towing Services is operated as a division of MCH Enterprises and provides towing and roadside-assistance services in Buffalo and surrounding Western New York service areas.

Service availability depends on location, road conditions, weather, vehicle type, vehicle weight, equipment limitations, driver availability, safety conditions, and applicable legal restrictions.

3. No Guarantee of Service or Dispatch

Submitting an online quote request, payment authorization, form, text message, voicemail, or email does not guarantee that Buffalo Towing Services has accepted the job or dispatched a driver.

A service request is accepted only after Buffalo Towing Services confirms the request and determines that the service can be performed safely and legally.

4. Service-Area and Road Restrictions

Buffalo Towing Services generally provides service within its stated Western New York service area.

We do not provide out-of-state towing through the online calculator.

We do not provide service on Interstate 90, Interstate 190, Route 33, or Route 198 unless the company specifically confirms that service is legally permitted and available.

The customer should call 716-324-1023 before submitting payment when the vehicle is located on or near a restricted roadway.

5. Customer Authority

The customer represents that they are the vehicle owner, an authorized driver, an authorized representative, or otherwise legally permitted to request towing or roadside assistance for the vehicle.

Buffalo Towing Services may request identification, registration, proof of ownership, keys, or other documentation before moving or servicing a vehicle.

Service may be refused when ownership or authorization cannot reasonably be verified.

6. Customer Information

The customer agrees to provide complete and accurate information, including:

  • Full name, telephone number, and email address.
  • Accurate pickup and drop-off addresses.
  • Vehicle year, make, model, color, condition, and approximate weight.
  • Whether the vehicle rolls, steers, brakes, starts, and shifts into neutral.
  • Whether keys are available.
  • Any known damage, locked wheels, missing parts, low clearance, modified suspension, or access restrictions.
  • Any dangerous conditions, accident damage, fluids, debris, traffic hazards, or unstable ground.

Additional charges, delays, refusal of service, or cancellation fees may result when inaccurate or incomplete information causes additional work, travel, equipment requirements, or safety concerns.

7. Quotes and Price Estimates

Prices shown by the online calculator are estimates based on customer-provided information, route information, mileage, selected service, time of service, vehicle condition, and other available details.

An online estimate is not a guaranteed final price when the actual vehicle, location, route, access conditions, or required work differs from the information provided.

Additional charges may apply for circumstances including:

  • Additional mileage or a changed destination.
  • Waiting time or delayed access.
  • Locked wheels or an inability to shift into neutral.
  • Missing keys.
  • Accident recovery or difficult loading.
  • Snow, mud, ditches, embankments, or unstable surfaces.
  • Special equipment or additional labor.
  • Vehicle size or weight that differs from the information provided.
  • Tolls, parking fees, access charges, or other third-party expenses.
  • After-hours or weekend service charges.

Buffalo Towing Services will attempt to explain material pricing changes before performing additional work whenever reasonably possible.

8. Card Authorization and Payment

Customers paying by card may be required to complete a secure Stripe card authorization before dispatch.

The authorization may place a temporary hold on the customer’s available funds.

After service is completed, Buffalo Towing Services may capture the amount properly owed, up to the amount previously authorized, unless the customer separately approves an additional amount.

Payment is governed by the separate Payment Authorization Policy .

9. Cancellations and Refunds

A cancellation fee of up to $50 may apply after a driver has been assigned, dispatched, is traveling to the service location, or has arrived.

Completed services and costs already incurred are generally nonrefundable except when a billing error occurred or a refund is otherwise required by applicable law.

10. Estimated Arrival Times

Arrival and completion times are estimates only.

Traffic, weather, road closures, accidents, emergency calls, equipment problems, distance, customer delays, and other circumstances may affect arrival and completion times.

Buffalo Towing Services does not guarantee a specific arrival or completion time unless that guarantee is separately confirmed in writing.

11. Vehicle Condition and Existing Damage

The customer should disclose existing damage and remove valuables, loose items, personal belongings, toll tags, detachable accessories, and fragile property before towing whenever safely possible.

Buffalo Towing Services is not responsible for damage that existed before service, damage caused by a vehicle’s existing mechanical condition, or loss of unsecured personal property unless responsibility is established under applicable law.

The company may photograph or document the vehicle, service location, route, condition, and completed work for safety, service verification, payment documentation, insurance, and dispute-resolution purposes.

12. Roadside Assistance Limitations

Roadside assistance is intended to provide temporary help and does not guarantee that a vehicle is safe, mechanically sound, or suitable for continued operation.

The customer remains responsible for deciding whether to drive the vehicle after roadside assistance.

Buffalo Towing Services may recommend towing when continued operation appears unsafe or when the requested roadside service cannot reasonably correct the problem.

13. Refusal or Discontinuation of Service

Buffalo Towing Services may refuse, delay, or discontinue service when:

  • The service cannot be performed safely or legally.
  • The vehicle exceeds available equipment limits.
  • The customer provides inaccurate or misleading information.
  • The customer is threatening, abusive, intoxicated, violent, or interferes with safe operation.
  • The requested location is inaccessible or outside the available service area.
  • The customer cannot establish authority over the vehicle.
  • Payment authorization fails or required payment arrangements are not completed.

14. Customer Communication

By providing a telephone number or email address, the customer authorizes Buffalo Towing Services to contact them regarding the quote, service request, driver status, arrival, payment, receipt, cancellation, or other service-related matters.

Marketing text messages will only be sent when the customer provides any legally required separate consent.

15. Website and Calculator Availability

The website and calculator are provided for convenience and may occasionally be unavailable, delayed, incomplete, or affected by third-party services.

Buffalo Towing Services does not guarantee uninterrupted access to the website, route provider, payment provider, email service, mapping service, or other third-party systems.

Customers needing immediate assistance should call 716-324-1023 .

16. Third-Party Services

The website may use third-party services for payment processing, maps, routing, address suggestions, form delivery, hosting, email, and data storage.

Those services may have separate terms and privacy practices.

17. Limitation of Liability

To the extent permitted by applicable law, Buffalo Towing Services will not be responsible for indirect, incidental, special, or consequential losses arising from delays, missed appointments, lost business, unavailable transportation, loss of use, or circumstances outside the company’s reasonable control.

Nothing in these terms excludes or limits responsibility that cannot legally be excluded or limited.

18. Indemnification

To the extent permitted by law, the customer agrees to be responsible for losses or claims caused by the customer’s lack of authority over the vehicle, inaccurate information, unsafe instructions, undisclosed hazards, or violation of these terms.

19. Complaints and Disputes

Customers should contact Buffalo Towing Services promptly regarding service or billing concerns so the company can review the job record, quote, authorization, photographs, route information, timestamps, receipt, and other relevant documentation.

Nothing in these terms prevents a customer from exercising rights available through applicable law, a card issuer, a government agency, or a court with proper jurisdiction.

20. Governing Law

These Terms and Conditions are governed by the laws applicable in the State of New York, without limiting any mandatory consumer protections that apply to the customer.

21. Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

22. Changes to These Terms

Buffalo Towing Services may update these Terms and Conditions when business practices, services, technology, or legal requirements change.

The date shown at the top identifies the latest published version.

24. Customer Agreement

By requesting service, checking the checkout agreement box, or continuing to secure card authorization, the customer confirms that they have reviewed and agreed to these Terms and Conditions and the linked payment, cancellation, refund, and privacy policies.

These general business terms do not waive any rights or protections provided under applicable law. Legal review by a qualified New York attorney is recommended.
